CALIFORNIA PRIVACY POLICY

Boston Dynamics, Inc. (“Boston Dynamics,” “we,” “us” or “our”) respects your right to privacy. This policy describes our practices with respect to collecting and using personal information of California residents and consumers.

California Privacy Rights: Under the California Consumer Privacy Act (CCPA), California residents have the following rights, subject to certain exceptions as set forth in the CCPA:

  • Right to Know. You have the right to receive information from us regarding (i) the categories of personal information we have collected about you, (ii) the categories of sources from which we have collected your personal information, (iii) the business or commercial purposes for which we have collected your personal information, (iv) the categories of third parties to whom we disclose your personal information, and (v) the specific pieces of personal information we collected about you, in each case, in the twelve (12) months preceding your “right to know” request.
  • Right to Delete. You have the right to request the deletion of the personal information that you provided to us, subject to certain exceptions. Specifically, in certain instances we may not be able to process your request, such as (i) due to the existence of a legal obligation, (ii) to detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities, (iii) to debug, identify and repair errors that impair existing intended functionality, (iv) to engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent, (v) to complete a transaction for which your personal information was collected, (vi) to enable solely internal uses that are reasonably aligned with your expectations and compatible with the context.
  • Right to Correct. You have the right to request correction of inaccurate personal information that we maintain about you, taking into account the nature of the personal information and the purposes of the processing of the personal information.
  • Right to Non-Discrimination. You have the right to be free from discrimination by us as a result of you exercising your privacy rights conferred under the CCPA including an employee’s, job applicant’s, or independent contractor’s right not to be retaliated against for the exercise of their CCPA rights.

California consumers can exercise their privacy rights by contacting us at privacy@bostondynamics.com, calling us toll-free at (844) 916-1264 during business hours (Monday – Friday, 9am – 5pm ET, except Massachusetts holidays), or writing to us at Data Subject Rights c/o Compliance Department, Boston Dynamics, Inc., 200 Smith Street, Waltham, MA 02451.

We aim to substantively respond to any verifiable consumer request within five (5) business days of receipt of the request.

Information We Collect & Retention Periods: We have collected the following information on California residents in the proceeding twelve (12) months:

  • Identifiers: We collect personal information that can be used to identify or contact you. This includes information connected to your account with Boston Dynamics, such as your name, alias, account name, mailing address, phone number, email address.
  • Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)): In addition to your name, we collect your address, telephone number, bank account number, credit card number, debit card number, or any other financial information. Some personal information included in this category may overlap with other categories.
  • Internet or other electronic network activity: Includes browsing history, search history, IP address, information on your interaction with a website application, or advertisement.
  • Commercial information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

We do not collect or process sensitive personal information (as such term is defined under the CCPA).

If you only read or download information on our website, we do not collect or learn your name, email address, home address, or other personal information about you.

We retain the personal information in accordance with Section 8 of our general privacy policy.

Third Parties to Whom We Disclose Personal Information: Please refer to Section 5 of our general privacy policy.

No Sharing/Selling of Personal Information with Third Parties: We do not “sell” or “share” any of your personal information that is collected (as such terms are defined by the CCPA). We therefore do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

Compliance with Section 7027(m): We do not use or disclose sensitive personal information for purposes other than those specified in Section 7027(m) of the implementing regulations of the CCPA.

Please note that the CCPA and “Shine the Light” Law are different laws offering different rights and requests must be made separately.
